1. Scope

These Terms and Conditions apply to all purchase contracts concluded via the online shop between Sonia Abassi Jewelry (hereinafter “the Seller”) and the customer (hereinafter “the Customer”).

2. Conclusion of Contract

2.1  All product listings in this online shop are non-binding and serve as an invitation to place an order.

2.2  By clicking “Check Out”, the Customer submits a binding offer to purchase the items contained in the cart.

2.3  After the order has been placed, the Customer will receive an order confirmation by e-mail. This confirmation only acknowledges receipt of the order and does not constitute acceptance.

2.4  The contract becomes legally binding once the Seller explicitly accepts the order by sending a separate confirmation e-mail within two (2) business days.

If no confirmation is received within this time, no contract has been concluded.

3. Products, Availability & Descriptions

3.1  The subject of the contract is the product specified in the order confirmation at the prices indicated in the online shop.

3.2  Images and descriptions are for illustrative purposes only. Colors and details may vary due to screen settings or material properties. Such variations do not represent defects.

3.3  If a product is permanently unavailable, the Seller will inform the Customer and no contract will be concluded.

3.4  If a product is temporarily unavailable, the Customer will be informed immediately.

4. Prices, Payment & Delivery

4.1  All prices are stated in EUR and are final prices.

In accordance with § 19 (1) UStG (small-business regulation), no VAT is charged or shown.

4.2  Payment options are provided via Shopify Payments, including prepayment, PayPal, and major credit cards.

4.3  Shipping times are generally 1 – 4 business days within Germany.

4.4  For deliveries outside the EU, additional fees or import duties may apply and are the Customer’s responsibility.

4.5  If a parcel cannot be delivered and is returned to the Seller, the Customer bears the cost of the failed delivery, unless not responsible for the non-delivery.

4.6  Collection in person is not possible for logistical reasons.

5. Retention of Title

The goods remain the property of the Seller until full payment has been received.

6. Warranty

The statutory warranty rights under German law apply.

7. Limitation of Liability

7.1  The Seller shall not be liable for damages, except for injury to life, body, or health, or for breaches of essential contractual obligations (cardinal duties), or damages caused intentionally or by gross negligence.

7.2  For breaches of essential obligations caused by simple negligence, liability is limited to foreseeable, typical damages.

7.3  Essential obligations are those whose fulfilment enables the proper performance of the contract.

7.4  The above limitations also apply to legal representatives and agents of the Seller.

7.5  Provisions of the German Product Liability Act remain unaffected.

We are not obliged or willing to participate in consumer arbitration proceedings.
